These Terms of Service ("Terms") govern your access to and use of the AssessAI360 online software platform (the "Platform") operated by AssessAI360 LLC ("COMPANY," "we," or "us"). By creating an account or using the Platform, you agree to be bound by these Terms, our Privacy Policy, and any additional terms that may apply to specific features of the Platform.

If you do not agree to these Terms, you may not access or use the Platform.

We reserve the right to change these Terms from time to time. The latest version will always be available on the Platform with the effective date. By continuing to use the Platform after changes are posted, you accept the Terms as modified.

2. The Platform and AI Assistance

AssessAI360 is an online AI-assisted software platform that helps school psychologists and related professionals organize assessment data, support eligibility documentation, collect and analyze behavior data, and generate report narrative drafts.

The Platform provides AI assistance for organizing information, analyzing entered data, generating drafts, and supporting workflows. AI does not independently make educational, psychological, diagnostic, eligibility, behavioral, or legal decisions.

Evaluation findings, eligibility decisions, and all professional judgments remain the responsibility of qualified professionals and multidisciplinary teams. The Platform is a tool to assist professionals and does not replace a school psychologist or professional judgment.

3. Account Registration

To access certain features of the Platform, you must register and create an account. You agree to provide accurate, current, and complete information during the registration process, including your occupation and state of practice.

You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account. If you suspect unauthorized use of your account, notify us immediately at email to be confirmed. We are not liable for any loss or damage arising from your failure to comply with this obligation.

4. Professional Responsibility

You are solely responsible for the content you enter into the Platform and for reviewing, verifying, and finalizing all AI-assisted output before use. You are responsible for ensuring that your use of the Platform complies with all applicable laws, regulations, professional standards, and district or employer policies.

The Platform does not guarantee the accuracy, completeness, or legal sufficiency of any generated draft or report. You must apply your own professional judgment to all output.

5. Supported Assessment Instruments

The Platform supports data entry from certain third-party standardized assessment instruments. These instruments are presented only as assessments the Platform can accommodate.

AssessAI360 LLC does not own, publish, sponsor, endorse, or have any official relationship with the publishers of these instruments unless separately confirmed in writing.

6. California Documentation Support

The Platform includes tools that support documentation related to California Education Code requirements. The Platform does not ensure legal compliance, and school psychologists remain responsible for confirming that documentation meets all applicable statutory obligations.

7. Subscriptions and Pricing

Access to the Platform may be provided via subscription, district arrangement, or free trial access where applicable. Specific subscription fees, billing terms, and renewal cycles are presented during account sign-up and checkout.

The Platform is provided "as is" and without warranties of any kind, either express or implied. To the fullest extent permissible pursuant to applicable law, we disclaim all warranties, including implied warranties of merchantability and fitness for a particular purpose.

We do not warrant that the Platform will be error-free, uninterrupted, or that any AI-assisted output will be accurate or complete. You agree at all times to indemnify and hold harmless AssessAI360 LLC, its affiliates, and their respective officers, directors, agents, and employees from any claims, damages, liabilities, costs, and expenses arising out of or related to your use of the Platform or your breach of these Terms.

10. Termination

We reserve the right to terminate or suspend your access to the Platform, without notice, if we determine that you have violated these Terms or engaged in conduct that we deem inappropriate or unlawful. Upon termination, you must cease all use of the Platform and any content obtained from it.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the applicable state of jurisdiction in which AssessAI360 LLC operates, without regard to its conflict of law provisions.

12. Changes to Terms of Service
